1. Introduction

The general terms and conditions set out below apply to the Tumaker company and brand, which is owner of the website, as well as to all branded devices. The general terms and conditions may be modified from time to time shall apply from their publication on the Internet. Not reading them does not release you from the responsibilities established herein.

2. Manufacturer’s Commercial Warranty

All products sold by Tumaker include the official manufacturer's warranty covering manufacturing defects. The warranty is valid for one year (12 months). Excepted are some components which, due to being fungible, accessory and interchangeable, have 90 days of warranty after purchase of the product. These are: In 3D printers: Hotend module, printing platform, Bowden tube. In 3D scanners: Calibration panels. No warranty is made with respect to any consumable, whether or not provided with the product (including cardboard, packing materials, power cords, USB cables, coil, user manuals and tools).

2.1. Overview of warranties

This Limited Warranty does not cover:

  • User manuals or software, content, data or links of third parties, configuration, included or downloaded in the Product or during installation, assembly or delivery, nor any of those incorporated at any other time into the delivery chain or otherwise acquired in any manner by you. Tumaker does not warranty that Tumaker software will fit your needs, work in combination with any hardware or software provided by an independent supplier, nor the resale, repair or replacement of the Product licensed by Tuamker.
  • Normal wear and tear (including, without limitation, wear of mobile elements). Defects caused by rough handling (including, without limitation, defects caused by added or bent elements, compression or falls, etc.). Defects or damage caused by misuse of the Product, including use contrary to the instructions provided by Tumaker. Other acts beyond the reasonable control of Tumaker.
  • Defects or alleged defects caused by the fact that the Product was used with, or in relation to to, any product, equipment, software and/or service not manufactured or supplied by Tumaker, or if used in a manner other than it was designed for.
  • The deterioration of the Product, if exposed to unsuitable environmental conditions, moisture or extreme atmospheric or thermal conditions or rapid changes thereof, or to corrosion, oxidation, spilled food or liquid, or to the infuence of chemicals.
  • Firmware other than that provided or the use of a database other than that recommended.
  • Direct or indirect damages arising from the use of a material other than that provided by Tumaker, or the use of a consumable in an inappropriate condition (with attached elements, traces of grease or other similar incidents), for printing.
  • Deterioration caused by improper transport: use of a packaging different to the original.
  • Connection to a voltage other than that configured by the manufacturer.
  • If Tumaker products have been repaired or altered by staff other than Tumaker’s or that of authorised Partners.
  • If the documentation and information requested by Tumaker is not presented.
  • If the elements which, due to their nature, require periodic maintenance, and there is evidence that this have not been performed.
  • If lack of functionality is a result of the buyers' lack of knowledge.

Returns

You have seven working days to return a Tumaker product. This term applies from the day you receive your order; the stamp from the mail service or transport service shall be used to determine the date of return.

• The product must have its original packaging, be in a new and complete condition (with all accessories, manuals, cables, etc.) and accompanied by the invoice.

• The merchandise must be received in perfect condition. Article sent incomplete, damaged or deteriorated shall not be accepted.

• Article loss or damage occurring during shipment is the responsibility of the client. We recommend returning items by certified mail or a courier service with insurance for the value of the product.

If all these requirements are met, we shall proceed to refund the amount of the returned item, always via the same form of payment that you used to pay the order, and excluding return shipping costs. Should the device show any flaws or damage, the amount required to repair it shall be deducted from the amount of the return. Should a technical analysis of the product be carried out in the framework of the right of withdrawal, Tumaker shall do everything possible to reimburse the money to the client in the shortest time possible.

3. Legal proceedings and liabilities

Tumaker is not liable for the non-execution of the present conditions in the event of force majeure, in the event of the failure of the client, or in a case of case of the client or in the event of an unforeseeable event by third parties unrelated to the contract.

Tumaker shall not be liable to the Purchaser of his/her failure or inability regarding the correct operation of Tumaker’s products. Not for the losses, damages, injuries or expenses of any kind or nature caused directly or indirectly by Tumaker’s products.

If for any reason it is necessary to send the Product to Tumaker’s facilities, we recommend that the product be sent with insurance that can cover any loss or damage. In any event, any incident related to transport is the responsibility of the buyer.

We advise the client to keep a copy of the information contained in the products purchased. Tumaker is not liable for any loss of information, files or, in general, for any damage resulting from a failure of the backup copy of the information contained in the products purchased.

Tumaker is not liable for any consequences that may result from the improper use of the products purchased on the website.

Tumaker cannot be deemed liable for the breach by one or more users of the rights of third parties through their activities on Tumaker's the website.

The parties submit, for the resolution of conflicts, hereby waiving any other jurisdiction, to the courts and tribunals of San Sebastián, Guipúzcoa.

4. Protection of personal data

The personal details supplied by the client are essential for shipping orders, preparing invoices and warranty contracts. By registering on the website, the client undertakes to provide valid personal details.

The personal details provided by the client are treated in accordance with the recommendations set forth by the AEPD (Data Protection Agency) and the legislation applicable in this matter. Tumaker is authorised by this body to take, s and use its clients’ personal details and this data shall be subject to computer processing. By providing his/her email address, the client authorizes Tumaker to use his/her address to process purchase orders, to facilitate browsing for and purchasing of items, as well as to inform the client, through this address, of Tumaker-related developments, it products or the www.tumaker.com website. The personal and/or financial details that the user voluntarily provides to Tumaker as a result of a commercial transaction shall not under any circumstances be reported or sold to third parties, but only gathered and stored in order to prevent access by unauthorised persons.

At any time, the client may exercise his/her rights of access, rectification, cancellation and opposition regarding his/her personal details in accordance with the European legislation and national laws in force.

5. Intellectual property

The entire content of the www.tumaker.com website (illustrations, text, names, marks, images, videos, etc.) is the property of Tumaker and is reserved in accordance with the copyright and the ownership of intellectual property. For this reason, and in accordance with the Intellectual Property Code, only private use thereof is permitted. Any other use (reproduction or unauthorised download) constitutes a violation punishable by law under the intellectual property law without the prior approval of Tumaker.

Thus, any total or partial reproduction of the contents of the www.tumaker.com website by any process and in any medium without the prior written authorisation of Tumaker is prohibited.

Tumaker forbid the copying, publication or distribution of any and all content to third parties that have no intellectual property rights. Any use of these contents in a fraudulent manner shall be considered an offence relating to industrial and intellectual property sanctioned by the Spanish Penal Code.
